The Lilongwe Magistrate Court in Malawi has denied the Bushiris the bid to request for their extradition to be dismissed or have the issue of the SADC protocol referred to the ConCourt.

The SADC protocol on extradition which the South African government used in a request to Malawi will not be used in the proceedings against the Bushiris.

Magistrate Patrick Chirwa said they would rely on the 1972 extradition agreement between Malawi and South Africa.

Bushiri’s lawyer was expected to file an application with the Lilongwe High Court after Chirwa’s decision to proceed with the hearing.

A few weeks ago Bushiri and his legal team filed an application requesting that the extradition should be dismissed but it seems the Malawian government is not giving in.

The case was postponed to the 4th of June 2021. Bushiri and his wife Mary are facing charges of money laundering, corruption and theft which they committed in South Africa.
